Read the following post to get a better sense of what the actual ruling was. Essentially, it was a dismissal of the Church's case questioning the validity of the Brotherhood as an organization and thus their ownership of the land the church is situated on. The case was dismissed with prejudice. Now there is a question as to who is the Brotherhood, when did they meet to vote on the project, and is the current makeup valid. It appears that the Church has taken it upon themselves to basically appoint all church members to the Brotherhood. Don't remember reading that in the by-laws of the Brotherhood. What the Church decided to do was declare everyone a member of the Brotherhood since the court has decided that they have no valid claim to the land. They just muscle their way in and if you get in the way, tough shit. They always have the power to excommunicate.

How totally evil are the members of this Church board? How totally evil are the clergy in this church that let this stuff happen? How evil is the developer (another priest) to break this church apart for his own private gain? What a total black eye for this Church and this religion. If we don't all stand up and say enough, this will be a black eye for the whole community. It is time we (the Phoenix included) expose all of this and stop tip toeing around the issues.

Well this tragic situation is just another example of what organized religion does to people.

Everybody, especially those who give their entire lives to a church, has their own idea of what God wants, according to "His Word" and we've spent the last 2000+ years fighting about it.

At the end of this HG mess there will be winners and there will be losers. Some losers will join the winning group and some losers will leave.

None of this has anything at all to do with God, what God wants, how we love God, who God loves more. That is all BS. It is once again just man against man, using his version of God as the ultimate trump card to empower himself over another.

To the outside community this kind of BS strengthens the overall growing belief that religions are made up of crazies and that anyone with any sense should stay away.

I'm going to predict that this large 'social' hall and education hall will sit empty most of the time anyway. Once this massive govt project takes up the prominent corner of Star and Bridge no one will be able to find this church let alone want to join it.

Any idea if the planning commission or borough council are going to revisit zoning for this tract and erase the HUGE MISTAKES made over the last year on changing a thing?

Evans should be run out of town and until the courts grant the church the right to sell, no zoning or advertising of such should proceed.

Tell Speck to go the the Moose for his votes and stay out of it already~:}

Dear Mark:

We have received a “Notice of a Special Meeting of the Board of Directors of Saint Nicholas Brotherhood of Phoenixville, Pennsylvania, Incorporated” which claims to be given in accordance with 15 Pa.C.S. §5701, to the effect that a special meeting of the Board of Directors of Saint Nicholas Brotherhood of Phoenixville, Pennsylvania, Incorporated (the "Brotherhood") will be held on Monday, December 8, 2008, at 7 p.m. at Holy Ghost Social Center, 55 Starr Street, Phoenixville, Pennsylvania. The date of the notice is not legible. It is signed by Jeanne O. Bass, above the printed title of Secretary of the Brotherhood.

I assume you are involved with this notice for the December 8 meeting.

As you know we have entered our appearance for the Brotherhood. Our clients include XXXXXX, who is the only living member of the original incorporators of the Brotherhood, and who has been a Trustee Director of the Brotherhood for its entire existence, and is a life trustee of Holy Ghost Church.

There have been no meetings of the members of the Brotherhood for many years, nor have there been elections for directors or officers. Any purported meeting at which Ms. Bass, or any other person, was elected as an officer or director of the Brotherhood is null and void.

Any purported business which occurs at the December 8 meeting will be of no force and effect, and have no legal standing. If the unelected directors of the Brotherhood attempt to take any action, we shall explore our legal options. If you do not cancel the December 8 meeting, we ask that you make copies of this letter available to all who attend. XXXXX will be in attendance and will ask to read this letter to those assembled.

We understand there has been an agreement signed for the conveyance of a portion of the Brotherhood real estate. We request that copies of that agreement be made available to Mr. Orosz and to our office.

Thank you for your anticipated cooperation.

Glory be to Jesus Christ, Christ is in our Midst,

I humbly request that you review your letter dated September 3, 2008 as I dispute your claims and
do not feel the excommunication is justified.

I have read closely on several occasions the letter along with the outline of the facts as you understand
them and would submit to you that there are several discrepancies. I never spoke out at any borough council
or public meeting nor the one you mention in your letter held on April 15, 2008. This may be verified as the meetings are a matter of public record and subsequently videotaped. Your office never sent me a letter warning me of any actions in May 2008 as stated within your letter. Most importantly I did not create nor lead a sect or division in the Parish of our beloved Holy Ghost Orthodox Church in Phoenixville, PA.

In my opinion, mailing this type of communication to John Bilanin, Michael Kost, Mark Samilenko and Father John Fedornock, before me is not an appropriate way to handle such a confidential and delicate matter between myself and the most Holy Sacrament of our Lord and Savior Jesus Christ.

Never did I curse Father John Fedornock in vile words and this is a complete fabrication of the facts. The accusation made by Pani Fedornock, which I discussed at length with Father John, Pani and Father Miloro were admitted to be inaccurate by the parties of the Fedornock family as noted on my answering machine tape which I still have in my possession. I went to confession since this accusation to change the state of sin, Father and Pani claimed I had, just to avoid future embarrassment by the horrible use of the sacraments as punishment for my views on the sale of the property back in March 2008 as we had discussed when he blessed my home. The cursing accusation Father Miloro agreed was not justification for excommunication even if were true, as done first during Presanctified in front of my daughter and parish as well as threatened punishment over the telephone on my same answering machine.

Based on the above and the fact that I pray to the Holy Trinity every day, pray and read the Bible every day and have always attended services regularly at Holy Orthodox Church, I am officially going on record disputing your harsh words, letter, and proclamation in public through Father John Fedornock. Father John’s decision in reading this letter from the pulpit, leaking it the press and then mailing copies to the multiple people is harassment and defamation of character. I pray you can have whomever did this to my family apologize and reverse as I have not lead any sect, cult or schism and know of over 75 parishioners whom
have had trauma over this fiasco. Using the sacraments of our beloved Lord and Savior as extortion is an embarrassment to our faith. Conversely, the many men who did speak out against this sale have had no letters or punishment which also breaks a few laws.

God bless you and please cease and desist any additional harassment on the phone and by mail from Father John Fedornock regarding the sale of the property. My nine year old daughter is a lovely, Holy Orthodox Christian who should not be punished, nor should I, for wanting the land to be intact for our church.

I look forward to a discreet, swift reversal to my status as an Orthodox Christian in writing with the hope that I may be in a position to devote my energy to the success of Holy Ghost Orthodox Church moving heavenward and forward….

THIS LETTER HAS NEVER BEEN RESPONDED TO AND THE MAILINGS AND NEWSLETTERS CEASED THE FOLLOWING MONTH. SINCE THEN I HAVE ATTENDED BUT HAVE NOT GONE FOR COMMUNION.

IN THE MEAN TIME, UNDER OTHER JURISDICTIONS OF ORTHODOXY, I WAS BLESSED WITH A WONDERFUL SUNDAY SCHOOL CLASS, MY DAUGHTER AND I SING IN THE CHOIR AND HAVE FELT SPIRITUAL STRENGTH FROM WITHIN AND PRAY FOR HEALING IN THE MINDS OF THOSE THAT HURT OUR BIRTH PARISH AND HOME OF HOLY GHOST.
